Si vous avez besoin d’une protection dans l’un des États membres de l’UE, où votre entreprise est actuellement basée ou où vous prévoyez de faire du commerce, vous procéderez selon le schéma suivant. Vous pourrez déposer une demande d’enregistrement de votre marque auprès de l’institution nationale compétente chargée de la réglementation de la propriété intellectuelle. C’est un exemple d’action au niveau national.
Si vous avez besoin d’une protection aux Pays-Bas, au Luxembourg ou en Belgique, vous pouvez vous adresser à l’Office Benelux de la propriété intellectuelle. Il s’agit de la seule institution régionale de réglementation de la propriété intellectuelle dans l’Union, conçue pour protéger les marques dans les trois pays répertoriés.

Les systèmes aux niveaux national, régional et paneuropéen (UE) sont complémentaires les uns des autres et fonctionnent en parallèle. Les entrepreneurs qui n’ont pas besoin de la protection des marques au niveau de l’ensemble de l’Union européenne ont besoin de marques nationales et régionales.
De plus, une autre façon d’obtenir une protection est internationale. Vous pouvez obtenir une protection internationale de la marque dans l’un des pays qui ont signé le Protocole de Madrid.
Aujourd’hui, il y a 2 options pour enregistrer un logo commercial dans l’UE. La première consiste à enregistrer la marque de l’UE par l’intermédiaire de l’Office de l’harmonisation du marché intérieur ou de l’OHMI.
Pour ce faire, vous devrez contacter une personne qui est un conseil en brevets de l’un des États de l’Union et qui a un tel statut qui serait officiellement confirmé. L’avocat prépare le paquet de documents nécessaire et les envoie pour vérification et enregistrement au Bureau européen. En général, la procédure d’enregistrement peut durer de 7 à 9 mois, s’il n’y a pas d’objections au brevetage de la part de tiers.
Si au moins un État rejette l’enregistrement de votre marque sur son territoire, la marque devient invalide dans l’ensemble de l’UE. Dans une telle situation, tous les paiements que vous avez déjà effectués ne sont pas remboursables.
